DUTIES:

This is a General Attorney Advisor position in the HHS Dallas Regional Office. The attorney will support the Regional Office for Civil Rights (OCR), which enforces health information privacy rules under the Health Insurance Portability and Accountability Act (HIPAA).  The attorney will be responsible for supporting OCR's resolution of potential HIPAA violations by covered entities and business associates, including reviewing OCR documentation, and working with OCR regional staff involved in HIPAA investigations, settlement negotiations, and administrative and judicial enforcement.  The attorney will also provide general legal advice to OCR on HIPAA regulatory activities and initiatives.

The attorney also assists OCR in enforcing federal civil rights laws that protect the rights of individuals and entities from unlawful discrimination  based on race, national origin, disability, age, and sex under various statutes, including Title VI of the Civil Rights Act of 1964, Title IX of the Education Amendments Act of 1972, the Americans with Disabilities Act, Section 504 of the Rehabilitation Act, the Age Discrimination Act, and Section 1557 of the Affordable Care Act, among others.  The attorney will be responsible for assisting OCR in investigating and resolving complaints of discrimination and taking enforcement actions when required. The attorney will also provide legal advice to OCR on civil rights program initiatives, guidance documents, and regulatory activities.

In addition to supporting OCR, the attorney may also provide a variety of legal services to other Department components in the region, including the Centers for Medicare & Medicaid Services, the Food and Drug Administration, and the Indian Health Service on matters that often require coordination with other components of the Department, other OGC offices, or the U.S. Department of Justice.  Accordingly, the ideal applicant will also have experience with healthcare law, employment law, and/or civil litigation.

The applicant must demonstrate exemplary analytical, legal writing, and oral advocacy abilities, as well as excellent interpersonal skills.  The applicant must be an experienced attorney who is able to work independently and on a team with over 400+ OGC colleagues across the nation. Demonstrated experience in federal court or administrative litigation, negotiations, and/or a government law background is preferred.

This position will be filled at the GS-12, GS-13, or GS-14 level ($83,523 - $152,572) depending on experience and qualifications.  The position is located in Dallas, TX.  Reimbursement for relocation expenses is not available.

DUTIES:

The IHS branch provides legal advice to the Indian Health Service as it delivers health care to American Indians/Alaska Natives through more than 500 health care facilities. DUTIES:

This is a General Attorney position in the Region III OGC office located in Philadelphia, PA. We are seeking to fill the position at the GS-11 to GS-14 level ($70,275 - $153,866). The attorneys provide a variety of litigation and legal advisory services to and on behalf of HHS agencies, primarily those functioning within the five states (and the District of Columbia) that comprise Region III. The new hire will have responsibilities across various programs, focusing on Medicare and Medicaid financial, quality of care and program integrity issues (including nursing home enforcement, supplier enrollment appeals, healthcare bankruptcies, overpayment recoveries, provider reimbursement and disallowance of Federal funding). The new hire will also provide legal services to the regional Office for Civil Rights, which includes advice regarding enforcement of Federal civil rights statutes and HIPAA. The new hire may also provide advice and litigation services in general Federal law issues (such as employment law and labor relations; privacy and discovery of information; tort claims and malpractice litigation).

More generally, the new hire will work on matters involving the interpretation, application, and enforcement of statutes, regulations, and Department policies. DUTIES:

The incumbent will serve in an advisory attorney position (GS 11/12/13/14) in OGC's Ethics Division and provide professional legal services involving federal criminal conflict of interest statutes, standards of ethical conduct regulations, financial disclosure requirements, procurement integrity provisions, lobbying rules, and political activity restrictions. The work may involve providing detailed legal guidance to senior staff, engaging in complex and difficult legal research assignments involving new emerging authorities, unusual legal problems and/or highly sensitive information.

The incumbent will provide legal advice and guidance to the Associate General Counsel Ethics Division (or designee) and to employees of HHS on matters covered by the Ethics in Government

Act, the Federal Criminal Conflicts of Interest statutes and the government-wide Standards of Ethical conduct and related regulations. The incumbent will also provide guidance to prevent and/or determine possible violations of law, rule or regulations and to recommend appropriate corrective action to address ethics violations.

Ethics Division attorneys work closely with senior HHS officials, other HHS OGC attorneys, and may work with the White House Counsel's Office and the Office of Government Ethics (OGE) in clearing new political appointees for a conflict free appointment or in addressing specific recusal obligations required by law, rule or regulations. This often includes detailed work reviewing highly complex financial disclosure reports and portfolios to identify and resolve potential conflicts of interest.

The incumbent will also develop and present interactive training on various topics related to federal employee ethics requirements and the financial disclosure program at HHS. The incumbent will also plan and participate in ethics program oversight reviews, report writing, and follow-up. The duties may also include serving as liaison with the HHS Office of Inspector General (OIG) and participating in the referral of cases to OIG when necessary to address ethics violations. On occasion, the incumbent may work on press or Congressional inquiries related to the ethics program and FOIA responses. Overall, the incumbent will focus on HHS-wide, federal ethics program administration and compliance and will provide legal guidance and advice that aims to improve the administration of ethics throughout the entire department.

The duty station for the positions may be at the HHS headquarters in Washington, DC, or at an Ethics Division Satellite Office located in Rockville or Bethesda, MD.

QUALIFICATIONS REQUIRED:

DUTIES:

This is a General Attorney Advisor position in the HHS OGC-Region IX San Francisco Office. The attorney will be expected to provide a variety of legal services to one or more Department components in the region, including the Centers for Medicare and Medicaid Services, the Office for Civil Rights, and the Indian Health Service, on matters which often require coordination with other components of the Department, other OGC offices, or the U.S. Department of Justice.
