DUTIES:

The incumbent's primary responsibility will be to provide legal advice and litigation services to the Indian Health Service (IHS) regarding matters of federal employment law. This includes advising agency Human Resources personnel and management on adverse personnel actions subject to review by the Merit Systems Protection Board (MSPB), representing the agency in MSPB appeals, and litigating discrimination complaints against the agency before the Equal Employment Opportunity Commission (EEOC).

The IHS delivers health care to American Indians and Alaska Natives. OGC Region VIII provides a wide range of legal services to program administrators and health care professionals operating IHS programs located in the Great Plains and Billings Area Offices. OGC support of IHS in Region VIII also includes assisting the Department of Justice in matters involving the agency in federal district courts and United States Courts of Appeal, negotiating compact or funding agreements under the Indian Self-Determination and Education Assistance Act, and handling a variety of other legal issues.

The Region VIII OGC office has a collegial staff of 14 employees, including 12 attorneys. OGC attorneys work independently and as a team with more than 600 colleagues across the nation. In addition to supporting the IHS, the incumbent may also participate in providing services to the Centers for Medicare & Medicaid Services, the Administration for Children and Families and other HHS agencies. Other areas of practice in the Denver office include: Medicare enforcement litigation, civil rights, administrative law, torts, fiscal law and information law, among others.

QUALIFICATIONS REQUIRED:

DUTIES:

These are general attorney positions in the CMS Division.  CMS Division attorneys provide a broad range of legal services for several of HHS's grant and public benefit programs, including Medicare, Medicaid, and CHIP.  The Division also represents the Office of the National Coordinator for Health Information Technology.  These positions offer a broad range of experience, significant responsibility, and intellectually engaging work.  They require creative legal thinking and strong communication skills.  Attorneys will have direct client contact and interactions with colleagues throughout OGC and other government offices.  Ideal candidates will have strong academic credentials, significant regulatory and administrative law experience, and superb writing, communication and analytical skills.  We have openings in our program review (advice), litigation and program integrity groups. 

Program Review Group attorneys provide legal advice regarding policies, regulations, and guidance, including Federal Register documents, National Coverage Determinations, Innovation Center model documents, Medicaid section 1115 demonstrations, State Medicaid director letters, reports to Congress, GAO reports, press materials, and significant correspondence.  We expect that the attorneys hired for Program Review Group positions will be drafting advisory opinions and will also be serving as subject matter experts who support our Litigation Group and the Department of Justice (DOJ).

We are seeking candidates with knowledge of health IT, HIPAA, and other Federal privacy and security requirements. Well-qualified candidates will have experience with health care data issues, including individual access and third-party sharing.  Ideal candidates will be familiar with ONC's health IT initiatives and activities, including health IT standards and certification criteria, the ONC health IT certification program, the health IT strategic plan, and the federal advisory committees that advise ONC. We are especially interested in candidates with knowledge of the HITECH Act and title IV of the 21st Century Cures Act.  Knowledge of the Substance Abuse and Mental Health Services Administration confidentiality regulations and federal grants law is also desirable, but not required.

In addition to candidates with health IT, privacy law, and/or data expertise, we are seeking candidates with a broad knowledge of health care and administrative law for general Program Review Group work. Program Review Group attorneys work closely with the Department and client agencies to provide legal advice on a variety of health care matters. Much of the Program Review Group work involves regulatory work, so ideal candidates will have significant experience with Administrative Procedure Act rulemaking issues. Demonstrated experience or familiarity with Medicaid, Medicare Advantage, CMS quality reporting and incentive programs, Innovation Center models, and Medicare payment, coverage and eligibility is desirable.

Litigation attorneys defend CMS in federal court litigation, both directly representing the Department and by supporting DOJ. Our litigation caseload spans a broad range of complex topics, including high-profile Medicare reimbursement and coverage cases, and defense of Medicaid and ACA regulations and policies.

Attorneys in the Program Integrity Group work closely with the Office of the Inspector General and DOJ on matters relating to health care fraud enforcement activities.  Program Integrity Attorneys also advise client agencies on matters arising under the Department's various program integrity and enforcement authorities, including authorities governing provider revocations, suspensions, terminations, and enrollment; the HITECH Act and title IV of the 21st Century Cures Act; and application of the physician self-referral law and anti-kickback statute.  In addition to other duties, we anticipate that attorneys hired for Program Integrity positions will be drafting advisory opinions.

DUTIES:

The incumbent will serve in an advisory attorney position (GS 11/12/13/14) in OGC's Ethics Division and provide professional legal services involving federal criminal conflict of interest statutes, standards of ethical conduct regulations, financial disclosure requirements, procurement integrity provisions, lobbying rules, and political activity restrictions. The work may involve providing detailed legal guidance to senior staff, engaging in complex and difficult legal research assignments involving new emerging authorities, unusual legal problems and/or highly sensitive information.

Act, the Federal Criminal Conflicts of Interest statutes and the government-wide Standards of Ethical conduct and related regulations. The incumbent will also provide guidance to prevent and/or determine possible violations of law, rule or regulations and to recommend appropriate corrective action to address ethics violations.

Ethics Division attorneys work closely with senior HHS officials, other HHS OGC attorneys, and may work with the White House Counsel's Office and the Office of Government Ethics (OGE) in clearing new political appointees for a conflict free appointment or in addressing specific recusal obligations required by law, rule or regulations. This often includes detailed work reviewing highly complex financial disclosure reports and portfolios to identify and resolve potential conflicts of interest.

The incumbent will also develop and present interactive training on various topics related to federal employee ethics requirements and the financial disclosure program at HHS. The incumbent will also plan and participate in ethics program oversight reviews, report writing, and follow-up. The duties may also include serving as liaison with the HHS Office of Inspector General (OIG) and participating in the referral of cases to OIG when necessary to address ethics violations. On occasion, the incumbent may work on press or Congressional inquiries related to the ethics program and FOIA responses. Overall, the incumbent will focus on HHS-wide, federal ethics program administration and compliance and will provide legal guidance and advice that aims to improve the administration of ethics throughout the entire department.

The duty station for the positions may be at the HHS headquarters in Washington, DC, or at an Ethics Division Satellite Office located in Rockville or Bethesda, MD.

This is a General Attorney Advisor position in the HHS OGC-Region IX San Francisco Office. JOB SUMMARY:

The Office of the General Counsel will be recruiting for multiple positions under this announcement ranging from GS-13 to GS-15. OGC's newly-formed National Complex Litigation Division (NCLD) serves as the in-house counsel for the Department on large, complex cases from across the HHS litigation portfolio, which runs the gamut from nationwide class action litigation against HHS programs operated by the Centers for Medicare & Medicaid Services (CMS), the U.S. Food and Drug Administration (FDA), and the Administration for Children and Families (ACF), to administrative litigation challenging health care privacy or other enforcement actions by HHS components such as the Office of Civil Rights (OCR), to disputes involving tens of millions of dollars in grant funding administered by the National Institutes of Health (NIH), the Centers for Disease Control and Prevention (CDC), and ACF. In addition, the NCLD serves as the in-house counsel for HHS on matters that involve consent decrees or court-ordered external monitors.

NCLD litigators will report directly to the Immediate Office of the General Counsel (IO), and will work closely with the Associate General Counsels (AGCs) and program attorneys from the other OGC Divisions: CMS; Children, Family and Aging; Civil Rights; Food and Drug; and Public Health. They will also work closely with attorneys from the U.S. Department of Justice (DOJ).

DUTIES:

  • Brief the IO and AGCs on new court filings and orders.
  • Develop litigation strategy together with DOJ and HHS stakeholders.
  • Draft or review and comment on draft pleadings, motions, and memoranda of law.
