Different Appeals at DAB

The kind of decision you are appealing determines which kind of judges (Board, DAB ALJ, or Council) will hear your appeal.

Appeals to Board

The Board hears appeals from many types of HHS program decisions, including grant disallowances and terminations, and appeals from DAB ALJ decisions.

Appeals to DAB Administrative Law Judges (ALJs)

DAB ALJs hear appeals from some CMS, SSA, HHS IG, and FDA actions, including civil money penalties, Medicare enrollment/revocation, and exclusions.

Appeals to the Medicare Appeals Council (Council)

The Council hears appeals of decisions by ALJs at the Office of Medicare Hearings and Appeals on Medicare coverage and payment claims.
