Maximum Penalty for violation of the Patient Safety and Quality Improvement Rule remains $11,000

The maximum civil money penalty that may be imposed for violation of the confidentiality provisions of the Patient Safety and Quality Improvement Rule will remain $11,000.  The Federal Civil Penalties Inflation Adjustment Act of 1990 (Inflation Adjustment Act) requires HHS to adjust for inflation the Patient Safety and Quality Improvement Act’s (PSQIA) civil money penalty amount at least once every four years, beginning from the PSQIA’s date of enactment, which was July 29, 2005.  OCR has determined, based upon the formula provided in the Inflation Adjustment Act, that no adjustment to the PSQIA civil money penalty is required in 2013.
