OGC is comprised of three principal subcomponents: the Immediate Office, the Headquarters Divisions and the Regional Offices. DUTIES:

The attorney will provide legal advice and services to OCR on issues related to the enforcement and administration of the HIPAA Privacy, Security, and Breach Notification Rules. The attorney will be responsible for supporting OCR’s enforcement of potential HIPAA violations by covered entities and business associates, including reviewing OCR documentation, and working with regional civil rights offices involved in HIPAA investigations, settlement negotiations, defending challenges to agency actions before administrative law judges, as well as assisting the Department of Justice with cases brought in Federal court. The attorney also will provide legal advice on various OCR regulatory activities; on program initiatives, including the HIPAA audit program; on HHS, other Federal agency, and Congressional initiatives affecting health privacy; and on guidance documents related to the HIPAA Rules, including the application of HIPAA to emerging technologies.  CRD HIPAA attorneys also serve as intra-Department and interagency advisors on matters related to health information privacy and security. 

We are seeking to fill the position at the GS-11 to GS-14 level, depending on experience and qualifications. Reimbursement for relocation expenses is not available.

QUALIFICATIONS REQUIRED:

  • You must possess a Juris Doctorate (J.D.) from an accredited ABA law school.

QUALIFICATIONS PREFERRED:

Demonstrated experience in complex litigation and familiarity with the Administrative Procedure Act is desirable.

The Public Health Division's Public Health and Science Branch will be hiring one or more permanent attorneys to provide a full array of legal services to the Agency for Healthcare Research and Quality (AHRQ), the Health Resources and Services Administration (HRSA), the Substance Abuse and Mental Health Services Administration (SAMHSA), the Office of the Assistant Secretary for Health (OASH), the Office of Minority Health (OMH), and/or the Program Support Center's (PSC) Federal Property Assistance Program. Much of the work of the Branch involves appropriations, grants, rulemaking, regulatory oversight, and litigation support, for which a background or interest in litigation would be useful.

These positions offer a broad range of experience, significant responsibility and intellectually engaging work, and require creative legal thinking and strong communication skills. Attorneys will have direct client contact, interact with colleagues throughout OGC and officials at other government agencies, and negotiate and work cooperatively with outside counsel. For this position, we are seeking one or more attorneys to join the legal team that advises the Office of the Assistant Secretary for Health's Office of Research Integrity (ORI) and work on other matters within the purview of the Public Health and Science Branch as needed. ORI oversees research misconduct proceedings conducted at institutions and provides educational resources pertaining to research integrity. The duties of this position include advising on ORI's regulation (42 C.F.R. part 93); reviewing research misconduct cases and evidence, including scientific data and research records, to assist in settling cases, determining legal sufficiency, and drafting charge letters in specific cases; defending appealed charge letters before administrative law judges of the Departmental Appeals Board; giving presentations at educational conferences upon ORI's request, and reviewing co-sponsorship agreements and grants announcements.

We are seeking to fill the position at the GS-11 to GS-15 level ($72,750 - $172,500) depending on experience and qualifications. For this position, we are seeking one or more attorneys to join the legal team that advises HRSA's Provider Relief Bureau (PRB), and to work on other matters within the purview of the Public Health and Science Branch, as needed.  The PRB oversees and administers several HHS programs supporting health care providers impacted by the pandemic by reimbursing necessary expenses or lost revenues attributable to COVID-19.  The PRB administers the HHS Provider Relief Fund, the COVID-19 Uninsured Program, the Coverage Assistance Fund for the underinsured, and a new rural reimbursement fund established under the American Rescue Plan Act of 2021 (the ARP Rural Program). The duties of this position include interpreting authorizing statutes, reviewing program terms and conditions, advising on compliance and program integrity (including reporting requirements and audits), coordinating bankruptcies and collection activities, and advising on an appeals process.

DUTIES:

This is an opening for a General Attorney position in the GLD’s Claims and Employment Law Branch (CEL).  CEL is seeking an attorney to handle a full range of federal-sector employment and labor law litigation and advice.  Areas of responsibility include representing the Department before the Merit Systems Protection Board (MSPB), Equal Employment Opportunity Commission (EEOC), Federal Labor Relations Authority (FLRA), and arbitrators.  This includes preparing and responding to discovery requests, conducting depositions, representing the Department at administrative hearings, and motion writing.  Employment law attorneys also provide litigation support to the Department of Justice when employment cases are appealed into federal court.  Other duties include advising and preparing legal opinions on myriad federal-sector employment and labor law issues such as appointment authorities, compensation, collective bargaining, and performance/adverse actions.

DUTIES:

The Civil Rights Division attorneys will be called to provide legal advice on civil rights and conscience areas off the Division’s portfolio, with an important focus on OCR’s work to enforce federal cornerstone civil rights laws, including Titles VI and IX; the Americans with Disabilities Act, Section 504 of the Rehabilitation Act; the Age Discrimination Act; and Section 1557 of the Affordable Care Act, among many others.  The attorneys also will provide legal advice concerning the free exercise of religion, conscience protections, and protections against certain forms of religious discrimination, including enforcement of and compliance with laws applicable to HHS.

JOB SUMMARY:

The Office of the General Counsel (OGC) is recruiting for multiple positions under this announcement ranging from GS-13 to GS-15. OGC's National Complex Litigation and Investigations Division (NCLID) serves as the in-house counsel for the Department at large focusing on complex cases from across the HHS litigation portfolio. DUTIES:

The incumbent will serve in an advisory attorney position (GS 11/12/13/14) in OGC's Ethics Division and provide professional legal services involving federal criminal conflict of interest statutes, standards of ethical conduct regulations, financial disclosure requirements, procurement integrity provisions, lobbying rules, and political activity restrictions. The incumbent will also provide guidance to prevent and/or determine possible violations of law, rule or regulations and to recommend appropriate corrective action to address ethics violations.

Ethics Division attorneys work closely with senior HHS officials, other HHS OGC attorneys, and may work with the White House Counsel's Office and the Office of Government Ethics (OGE) in clearing new political appointees for a conflict free appointment or in addressing specific recusal obligations required by law, rule or regulations. This often includes detailed work reviewing highly complex financial disclosure reports and portfolios to identify and resolve potential conflicts of interest.

The incumbent will also develop and present interactive training on various topics related to federal employee ethics requirements and the financial disclosure program at HHS. The incumbent will also plan and participate in ethics program oversight reviews, report writing, and follow-up.
