Attorney Advisor - Legislation Division (Washington, D.C.)

DUTIES:

Senior attorneys in the Legislation Division draft Federal legislation that impacts the entirety of the Department of Health and Human Services.   The legislative issues are extremely complex and difficult legal questions that must be resolved by drafting clear and concise legislative language.  Senior Attorneys are responsible for drafting legislative language that balances the policy objectives of the Department with the legal and constitutional requirements of US Federal law. 

Legislation drafted by senior attorneys in the Legislation Division impacts broad segments of society.   Attorneys work on novel legislation introduced by Congress as well as amendments to such comprehensive and complex laws as the Social Security Act, the Patient Protection and Affordable Care Act, the Federal Food, Drug, and Cosmetic Act, the Public Health Service Act, the Indian Self-Determination and Education Assistance Act, and all Appropriations Acts.  

Senior attorneys in the Legislation Division work at the highest levels of the Department independently interacting with senior political and career officials.   Senior attorneys also routinely independently interact with the Office of Management and Budget and the White House.

Senior attorneys are responsible for drafting and evaluating the proposed legislation in terms of its foreseeable effect on agency programs, policies, procedures, regulations, methods of operation, and extent of operation, and on existing legislation.   In addition, senior attorneys manage legislative related requests from OMB and the White house. 

We are seeking to fill the position at the GS-15 level ($148,484 - $176,300). The position will be located in Washington, D.C., and reimbursement for relocation expenses is not available. The candidate must have at least three years of legal legislative drafting experience post bar admission.

DUTIES:

This is a General Attorney position located within the Office of the General Counsel (OGC) in the New York Regional Office (Region II).  Each regional office provides legal counsel and advice to all Departmental agencies with an emphasis on the advising agencies that have a presence in the given region.  There are currently 9 attorneys and two support staff in Region II, and Region II’s jurisdiction includes New Jersey, New York, Puerto Rico and the Virgin Islands.

Attorneys in Region II provide advisory opinions and litigation support to the Department in complex matters requiring extensive research and sophisticated analysis of administrative law, judicial decisions, and statutory and regulatory law, often in cases of “first impression.”  Region II attorneys represent the Department in administrative litigation before the Departmental Appeals Board to enforce quality of care and other federal requirements and to aid in the recovery of misspent Medicare, Medicaid and federal grant funds.  Attorneys also represent the Department in employment law cases before the Equal Employment Opportunity Commission and the Merit Systems Protection Board and provide legal advice to the Department regarding enforcement of the Federal civil rights statutes and HIPAA.  Region II attorneys work closely with the Department of Justice and Assistant United States Attorneys in federal court litigation in preparing legal briefing and assisting or presenting oral argument.

The selectee will be assigned a range of litigation and advisory matters involving Medicare financial and program integrity issues, nursing home quality of care compliance, physician and other provider/supplier enrollment determinations, employment and discrimination claims, Head Start financial and quality of care issues, and HIPAA compliance.  The selectee may also be called upon to assist in the handling of Medicare bankruptcy cases.

DUTIES:

This is a General Attorney Advisor position in the HHS Dallas Regional Office. The attorney will be expected to provide a variety of legal services to one or more Department components in the region, including the Centers for Medicare and Medicaid Services, the Food and Drug Administration, the Office for Civil Rights (OCR), and the Indian Health Service (IHS), on matters which often require coordination with other components of the Department, other OGC offices, or the U.S. Department of Justice. This is a General Attorney Advisor position in the HHS OGC-Region IX San Francisco Office. The attorney will be expected to provide a variety of legal services to one or more Department components in the region, including the Centers for Medicare and Medicaid Services, the Office for Civil Rights, and the Indian Health Service, on matters which often require coordination with other components of the Department, other OGC offices, or the U.S. Department of Justice.

Attorneys may represent the agency in litigation against hospitals, nursing homes, health plans, clinical laboratories, and other health care providers to enforce compliance with federal requirements; aid in the recovery of misspent Medicare, Medicaid, and federal grant funds; counsel health care providers and administrators at over 20 Indian Health Service operated hospitals and health care facilities throughout the region on a range of issues related to patient care and hospital operations; advise the Office for Civil Rights in the investigation and resolution of unauthorized uses and/or disclosures of personal health information by health care entities; and represent the agency in hearings before the Equal Employment Opportunity Commission (EEOC), the Merit Systems Protection Board (MSPB), and the National Labor Relations Board. Attorneys must be able to work independently and as a team with the 400+ OGC colleagues across the nation.

Demonstrated experience or familiarity in health law, employment law, federal court or administrative litigation or negotiations and/or a government law background would be helpful. Attorneys may litigate before the HHS Departmental Appeals Board, EEOC, MSPB, Civilian Board of Contract Appeals, or Interior Board of Indian Appeals.

This position will be filled at the GS-11, GS-12, GS-13, or GS-14 level ($75,515 - $165,346) depending on experience and qualifications. The positions will be located in San Francisco, CA or Sacramento, CA. Reimbursement for relocation expenses is not available.

QUALIFICATIONS REQUIRED:

The following are required qualifications:

  • You must possess a Juris Doctor (J.D.) from an accredited ABA law school.
  • Have at least (3) three years of experience after law school as a practicing attorney.
  • Possess proof that bar status is active, in good standing and eligible to practice before the highest court of a State, U.S. Commonwealth, U.S. Territory, or the District of Columbia.

The following qualifications are preferred:

  • Demonstrated experience in federal employment law
  • Demonstrated experience as a litigator (federal or administrative)
  • Demonstrated experience in health law
  • Demonstrated experience working with tribal organizations or government organizations
  • Ability to work independently and as part of a team

CONDITIONS OF EMPLOYMENT:

  • Must maintain active bar membership in good standing and be eligible to practice law before the highest court of a State, U. S. Territory, U. S. Commonwealth, or the District of Columbia.
  • Must submit official law school transcripts.
