MelroseWakefield Healthcare (MWH), a provider in Massachusetts, did not provide a personal representative with timely access to her mother’s records on the mistaken basis that the durable power of attorney in this instance did not allow for the provision of such medical records.  In addition to a monetary settlement of $55,000, MWH will undertake a corrective action plan that includes one year of monitoring their compliance with the HIPAA Rules.
